Omigo (hereinafter referred to as the "Platform") is operated by Blued Japan K.K. (hereinafter referred to as the "Company", “we,” “us,” or “our”). We deeply understand the importance of your personal data and value your trust. We will strictly comply with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable laws and regulations to protect your personal data and privacy.
This Privacy Policy will help you understand how we collect, use, store, transfer, and protect your personal data, and how you can manage it. Please read and understand this Policy carefully before using the Platform and related services, especially the important provisions highlighted in bold, so that you can make informed choices.
Key Highlights
  • We do not compulsorily bundle the collection of personal data solely because you have agreed to this Privacy Policy. We collect information only to the extent necessary to provide a specific feature or service.
  • Sensitive permissions such as camera, microphone, and storage (photo library) are not enabled by default. They are used only within the relevant feature context after you have expressly authorized them, and no information is collected when not needed for that feature.
  • You have the right to decline to provide non-essential information without affecting your normal use of other features or services.
  • Please ensure that the personal data you provide and authorize us to process does not infringe upon the lawful rights of others.
  • 1. How We Collect and Use Personal Data

    We collect only the information you actively provide and information generated during your use of features and acceptance of services through automated means, for the purposes described in this Policy, as detailed below:
    1.1 Account Registration and Login
    (1) When you create and register an account, you will need to provide personal data including your chosen username, account password, date of birth (if applicable), email address and/or phone number (if applicable), and any other information you choose to include in your public or private profile, such as your location, nationality, and biography. If you do not register an account, you may not be able to use the Platform and/or services.
    (2) You may also log in using a third-party account (e.g., Apple ID, Google Account). With your consent, we will obtain publicly available information from the third-party platform (e.g., profile picture, nickname) for account linking so that you can use the Platform directly.
    1.2 Core AI Social Companionship Features
    (1) To provide AI character creation, personalized interaction, and narrative experience services, we collect content you actively input (including text, voice, and images) and operational commands, analyze your needs and context, and generate tailored AI responses.
    (2) We record the history of your interactions with AI characters (including your inputs and AI outputs) to provide a continuous interactive experience. You may choose to restart a conversation or clear the history through character settings.
    (3) The Platform provides an AI memory feature: based on your conversation history with AI characters, the system summarizes and generates memory information about you for each character, which you can view and manage on the character's profile page. Certain membership services may include enhanced memory capabilities, such as the generation of exclusive memory virtual cards (subject to the character creator's settings).
    (4) Subject to security encryption and rigorous de-identification (rendering re-identification of specific individuals impossible), we may use such de-identified data for model training and optimization to improve the Platform's response speed, comprehension, and functionality.
    (5) When you proactively take a photo for your avatar, upload images, or input voice, we will request your authorization for camera, storage, and microphone permissions respectively. If you decline, you will not be able to use the image or voice features in the relevant context, but this will not affect other features.
    (6) To generate AI character visuals and narrative content, text and images you actively input will be transmitted to our servers for processing. All transmissions are encrypted, and the data will not be used for any other purpose without your authorization.
    1.3 User Feedback and Customer Service
    To handle your inquiries, complaints, or feedback, we may retain your account information, feedback content, and contact details in order to communicate the processing approach and outcome in a timely manner. When you file a complaint against another person or are the subject of a complaint, we may provide your account information, contact details, and complaint-related content to consumer protection authorities or regulatory authorities in order to protect the lawful rights and interests of all parties, except where prohibited by law.
    1.4 Notifications
    We may use the contact information you provide (e.g., phone number, email) to send you service notifications and other information.
    1.5 Operations and Security
    (1) To ensure normal service operation and protect your and the public's lawful interests, we collect necessary information to maintain the security and stability of the Platform.
    (2) Device and log information: including hardware model, operating system version, device identifiers (Android: AndroidID, OAID; iOS: IDFV, IDFA), IP address, network access type, service logs (including User ID), and device sensor data, used to prevent malware, troubleshoot issues, and optimize operational quality.
    (3) Application lists, running process information, and page crash data: used to prevent risks and improve service stability.
    1.6 Sharing and Interaction Features
    When you share or receive shared information or participate in activities, we may access your clipboard to read passwords, sharing codes, or links to enable redirection and activity linkage. You can enable or disable this permission through your device's system permission settings; disabling it will prevent use of the corresponding feature but will not affect other services.
    1.7 Payment Features
    (1) If you use paid features, we collect in-service top-up records, payment history, transaction dates, purchased goods or services, and transaction amounts. We do not collect or store any sensitive payment details such as your credit/debit card holder name, security code, or payment password. All such sensitive payment information is collected and processed exclusively by the third-party payment service provider you select to complete the transaction.
    (2) Payment institutions may collect additional information based on their own service requirements; please refer to the payment institution's privacy policy and your authorization for details.
    1.8 Changes in Purpose of Use
    If a new feature or service is not directly or reasonably related to the original processing purpose, we will separately notify you and obtain your consent before collecting or using your personal data.
    1.9 Exceptions That Do Not Require Prior Consent
    In accordance with applicable laws and standards, the following situations do not require your prior consent for the collection and use of personal data:
    1. Where required to fulfill statutory obligations;
    2. directly related to national security, defense security, public safety, public health, or major public interests;
    3. directly related to criminal investigation, prosecution, trial, or enforcement of judgments;
    4. necessary to protect your or another person's vital interests (such as life and property) where it is impractical to obtain consent;
    5. personal data that you have voluntarily disclosed to the public;
    6. personal data collected from lawfully disclosed public sources (e.g., news reports, government disclosures);
    7. necessary to maintain the safe and stable operation of software and services (e.g., troubleshooting);
    8. or other circumstances specified by law.
    Special Note
    Where information cannot independently or in combination with other information identify a specific individual, it does not constitute personal data in the legal sense. Where information can identify you, or is used in combination with other personal data, it is treated as personal data and protected under this Policy.

    2. How We Use Cookies and Similar Technologies

    Cookies and device identifier technologies are standard internet tools. We may send Cookies or anonymous identifiers to your device to collect, identify, and store information relating to your use of the Platform, solely for the purposes set out in this Policy:
    2.1 Ensuring secure and efficient operation of products and services: confirming your secure login status and preventing unauthorized access, fraud, and similar unlawful conduct, while improving service response speed.
  • 2.2 Optimizing your experience: helping you avoid re-entering information or search terms (e.g., by recording conversation context).
  • You may clear Cookies through your browser settings; however, disabling Cookies may prevent use of certain services or features that depend on this technology.

    3. Partners, Data Transfers, and Disclosures

    3.1 Partners
  • (1) Cooperation principles: We process personal data with partners in accordance with the principles of lawfulness, legitimacy, necessity, and security, assessing partners' security capabilities, entering into legal agreements, and monitoring compliant use.
  • (2) Commissioned processing: When commissioning third parties to process personal data, we execute processing agreements specifying both parties' rights, obligations, and processing scope.
  • (3) Joint processing: When jointly processing personal data with partners, we agree on each party's responsibilities to ensure data security and compliance.
  • (4) Partner scope: Includes affiliates and third-party service providers (e.g., payment processors, technology service providers).
  • (5) Data use scenarios:
    3.2 Data Transfers
    If a merger, acquisition, asset transfer, or similar business change occurs, your personal data may be transferred accordingly. We will require the successor to continue fulfilling personal data protection obligations. If the purpose or method of processing changes, we will re-obtain your consent.
    3.3 Data Disclosures
    (1) We will not disclose your personal data unless required by law or with your consent, and we will implement industry-standard security protection measures.
    (2) When announcing penalties for non-compliant accounts or fraudulent conduct, we may disclose relevant account information.
    3.4 Transfers and Disclosures Not Requiring Consent
    Providing personal data to partners or disclosing it does not require your prior consent in the following circumstances:
    1. Necessary to conclude or perform a contract or implement human resources management;
    2. necessary to fulfill statutory duties or obligations;
    3. directly related to national security, defense, public safety, public health, or major public interests;
    4. directly related to criminal investigation, prosecution, trial, or enforcement;
    5. necessary to respond to public health emergencies or to protect the life, health, or property of individuals in emergencies;
    6. news reporting or public opinion supervision in the public interest, within a reasonable scope;
    7. processing personal data you have voluntarily disclosed or that has been lawfully disclosed;
    8. or other circumstances specified by law.

    4. How We Store Personal Data

    4.1 Storage Location
    Your personal data associated with the Platform's services may be stored on servers in various jurisdictions, including jurisdictions outside your country of residence. We operate a global network of secure servers to ensure continuous and reliable delivery of the Platform's services to users worldwide.
    All personal data stored by us or our authorized service providers, regardless of the jurisdiction in which it is stored, is subject to the data protection and security measures described in this Privacy Policy. We ensure that any transfer of your personal data to a jurisdiction outside your country of residence complies with applicable data protection laws (including any required cross-border data transfer mechanisms such as Standard Contractual Clauses).
    4.2 Retention Period
    (1) We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including to provide the Platform's services, fulfill our contractual and legal obligations, exercise our legal rights, and resolve potential disputes. We also retain personal data for as long as we have a legitimate business interest in doing so (e.g., improving services, enhancing Platform security, and preventing fraud).
    (2) Retention periods vary by information type and purpose of use and comply with the minimum retention periods required by applicable law. The primary retention rules are as follows:
    Account and profile information: Retained for the duration of your account's active status and for a reasonable period after account deletion to resolve any outstanding disputes or fulfill legal obligations.
    User-generated content: Retained for as long as the content is publicly available on the service (or for the duration of your account, for private content) and may be retained for a shorter period after account deletion pursuant to our data minimization policy.
    Transaction and payment information: Retained as required by applicable financial and tax laws (typically several years), even after account deletion.
    Security and compliance data: Retained for as long as necessary to investigate security incidents, prevent fraud, and fulfill legal and regulatory obligations.
    Violation-related data: If you violate our User Agreement, this Privacy Policy, or other Platform rules, we may immediately remove your profile and user-generated content from public view, but we may retain information relating to the violation for the period required to resolve the violation, enforce our policies, and fulfill legal obligations.
    1. All personal data no longer needed for the stated purposes will be permanently deleted or anonymized in accordance with applicable law and our data retention policy. Anonymized data (which cannot be used to identify you) may be retained indefinitely for analysis and research purposes.

    5. How We Protect Personal Data

  • 5.1 Technical safeguards: We employ industry-standard encryption, anonymization, and other security measures, and have established security protection mechanisms to defend against malicious attacks on personal data.
  • 5.2 Management safeguards: We have established a dedicated security department, security management systems, and data security procedures, strictly limit access permissions, and conduct regular security audits.
  • 5.3 Risk notice: Internet transmissions are not absolutely secure. We cannot guarantee 100% information security. Please take proactive measures to protect your personal data, such as using strong passwords, regularly changing your password, and not disclosing account credentials.
  • 5.4 Incident response: We have developed an emergency response plan for personal data security incidents. In the event of an information breach or loss, we will immediately activate the plan, take remedial action, and notify you in a timely manner as required by law (including information about the incident, its impact, remedial measures, and recommendations). Where individual notification is impracticable, we will issue a public announcement and report to the regulatory authority.
  • 6. Managing Your Personal Data

    We protect your rights to access, copy, correct, supplement, delete, withdraw consent, cancel your account, and file complaints, as follows:
    6.1 Accessing, Correcting, Supplementing, and Deleting Personal Data
  • (1) Viewing basic information: via [Profile > Edit Profile], you may view your basic account information.
  • (2) Managing account data: via [Profile > Edit Profile], you may view and modify your nickname, avatar, gender, and other information.
  • 6.2 Changing or Withdrawing Consent
  • (1) You may enable or disable camera, microphone, storage, and other permissions in your device's operating system.
  • (2) You may also contact us at cs@omigoai.com for assistance with consent-related matters.
  • (3) After withdrawing consent, we will no longer collect information associated with that permission and will be unable to provide the corresponding feature, but this will not affect prior processing based on that consent.
  • 6.3 Account Deletion
    You may apply to delete your account via [Profile > Settings > Delete Account]. We will process the deletion within 15 business days (or within the period required by law) after verifying your identity and account status. Once your account is deleted, all associated information will be deleted or anonymized (unless otherwise required by law), and this action is irreversible.
    6.4 Complaints, Reports, and Feedback
    If you believe your personal data rights have been violated, or if you have questions or suggestions, please contact us at cs@omigoai.com. We will respond within 15 business days after verifying your identity.
    6.5 Cessation of Operations
    If we cease operations, we will promptly stop collecting personal data, notify you individually or by public announcement, and delete or anonymize all personal data we hold.

    7. Protection of Minors

    The Platform and its related services are exclusively for natural persons who are at least 18 years of age and have reached the legal age of majority in their applicable jurisdiction. Minors are prohibited from using the Platform. We will not knowingly or intentionally collect, process, or store personal data of Minors. If we discover that we have collected personal data from a Minor in violation of this Policy and applicable law, we will immediately take appropriate steps to permanently delete such information and terminate the Minor's account.
    Parents and legal guardians bear full responsibility for monitoring their children's online activities and ensuring that their children do not access or use the Platform. If a Minor provides false information to create an account (e.g., misrepresenting their age), the Minor's parents or legal guardians shall bear full responsibility for all consequences arising from the Minor's use of the service, including any violations of this Privacy Policy, the User Agreement, or applicable law.
    We strongly encourage parents and legal guardians to educate their children about online safety, privacy, and the risks of sharing personal data online. If you are a parent/guardian and discover that your child has created a Platform account and provided personal data, please contact us at cs@omigoai.com to request deletion of your child's information and termination of the account.

    8. Amendments and Notification

    8.1 We may amend this Policy in response to business developments or updates in law and regulations. The amended Policy forms part of this Policy and will not reduce the rights you enjoy under the currently effective Policy.
    8.2 After an update, we will notify you through in-Platform announcements, pop-up notifications, or other appropriate means. Your continued use of the Platform and its related services constitutes acceptance of the amended Policy. If you disagree, you should immediately stop using the Platform.
